It is hereby stated that the following conditions govern
sales on or for the ECOSSE.FR website, of links and advertising
space or other provision of services or products pertaining
to the promotion of Scotland in France. These conditions are
applicable at the exclusion of all other conditions, notably
those in force for shop sales.
ARTICLE 1 - PRICE
1.1 - Products are priced in Pounds Sterling and in Euros, and
are subject to French VAT at 19.6% unless stated otherwise.
1.2 - If you are ordering from a country other than metropolitan
/ mainland France you become the importer of the products concerned
and are responsible for any related declarations and payments
to the appropriate authorities in your country. For all products
sent outside the EU and French provinces, prices will automatically
be calculated excluding taxes on the invoice. Customs duty and
other local taxes or import duty or state taxes may be levied.
These duties and charges will not be met by TERRE D'ECOSSE.
We advise you to consult your local authority for full information
on your responsibilities in this respect.
1.3 - All orders regardless of origin are payable in Pounds
Sterling or Euros.
1.4 - TERRE D'ECOSSE reserves the right to alter its prices
at any time. Products will be invoiced based on the prices in
force at the time of ordering, according to availability.
All products remain the property of TERRE D'ECOSSE and its partners
until full payment is received.

Friday, 9.30am to 18:30pm (GMT Paris local).
Contractual information is presented in French and in English
and will be subject to confirmation of acceptance no later than
the date and time of delivery.
ARTICLE 3 - VALIDATION
By clicking on the 'validate' button at the end of the ordering
process, you accept fully and unconditionally these General
Conditions of Sale.
The information recorded by ECOSSE.FR constitutes the proof
of all transactions between TERRE D'ECOSSE and its clients.
The information recorded by the payment system constitutes the
proof of financial transactions.
ARTICLE 4 - AVAILABILITY
The services we provide are offered on a permanent basis, with
the exception of promotional offers limited to a specific period.
Offers of our products are dependent on available stock. Where
a product is not stocked in our own stores, offers are dependent
upon the availability of this product from our suppliers.
In this framework, information on product availability is provided
when your order is passed / approved. As this information comes
directly from our suppliers any errors or alterations are independent
of our control. Should a product prove to be unavailable after
your order has been passed you will be informed:

- by post in the shortest possible delay / return of post.

ARTICLE 5 - DELIVERY
5.1- Delivery of on-line services (referencing, stand, virtual
shop) concerning the site will take place within 45 days.
5.2 - Products will be delivered to the delivery address indicated
during the ordering process.
The delivery period is an estimate corresponding to average
delays for processing and delivery of products to metropolitan
/ mainland France. In the case of items available for delivery
on several different dates, the delivery period is based on
the longest expected delay. TERRE D'ECOSSE reserves the right
to divide deliveries if necessary. Only products which have
been sent will be debited. Postage and packaging costs will
only be invoiced for a single consignment. In case of unforeseen
delay, you will be notified by E-mail.
ARTICLE 6 - PAYMENT
Your purchases can be paid for by bank card: Visa, MasterCard,
American Express, JCB and various other credit cards.
Your card will not be debited until such time as the order is
despatched.
ARTICLE 7 - SECURITY
Our site operates with a secure system:
We use the SSL encryption system and have also reinforced the
mixing and encoding procedures to protect as effectively as
possible all sensitive information relating to payment.
ARTICLE 8 - SATISFACTION OR REFUND
8.1 - If a product is unsuitable it can be returned in the 7
days following delivery.
Return postage charges in this case will be met by the client.
Only the price of the product(s) purchased will be refunded.
Should a package be returned unopened, you will be refunded
the cost of product(s) purchased and the outward postage fees.
Returns should be directed to TERRE D'ECOSSE, 1 bis, rue de
Lanneau 75005 Paris , France.
8.2 - The right to return products is not valid for audio or
video recordings, computer programmes or food products unless
the seal remains intact. Articles returned incomplete, damaged
or soiled by the client will not be accepted.
8.3 - We will offer a refund or exchange of products which are
unsuitable (defective or not as ordered). In this case we would
ask you to state the reasons why the product(s) do(es) not meet
your specifications clearly on the order form when you return
the product(s). TERRE D'ECOSSE will then effect the exchange
or refund of the product(s).
In cases such as those outlined in article 8.3, postage costs
will be refunded to you. However, the sum of return postage
costs to be refunded must not exceed 1.5 times the postage costs
originally invoiced.
8.4 - Refunds will take place not more than 30 days after receipt
of the returned products.
Refunds will be made, at the discretion of TERRE D'ECOSSE, either
by direct payment to your bank account or by cheque in the name
of the client who placed the order and to the address on the
invoice.
8.5 - No dispatch in counter-reimbursement will be accepted,
whatever the grounds.

ARTICLE 10 - INTELLECTUAL PROPERTY / OWNERSHIP
All texts, commentaries, artwork, illustrations and images reproduced
on the ECOSSE.FR website remain the intellectual property of
their author; the right to be recognised as author is asserted
throughout the world. As such, and conforming to the Code of
Intellectual Property only reproduction for private use is permitted
and this being subject to restrictive conditions as detailed
in the Code of Intellectual Property. All other use constitutes
fraud and is sanctioned under the Code of Intellectual Property
except where prior written permission has been given by Terre
d'Ecosse. All reproduction in whole or part of works published,
presented or created by TERRE D'ECOSSE is strictly prohibited.
ARTICLE 11 - RESPONSIBILITY
All our products conform to current French legislation. TERRE
D'ECOSSE will not accept responsibility for infraction of the
legislation of the country to which products are delivered.
It is your responsibility to confirm with your local authorities
if it is possible to import or use the products and services
you wish to order. Photographs and texts reproduced on the site
depicting products are not contractual. As a result TERRE D'ECOSSE
will not accept responsibility in case of an error relating
to these texts or photographs.
TERRE D'ECOSSE will not be held responsible for non-fulfilment
of a contract in case of a product being out of stock or unavailable,
or due to natural disaster, partial or total disruption or strike
of postal services, transport services and /or communications,
flood or fire. TERRE D'ECOSSE will not be held responsible for
indirect losses resulting from the above and including loss
of sales or market share, loss of profit, costs or damages.

D'ECOSSE rejects all responsibility should the content of any
of these sites contravene current legal arrangements and regulations.
ARTICLE 12 - APPLICABLE LAWS - LITIGATION
This contract is subject to French law and is issued in both
French and English. In case of legal dispute only French law
courts will be considered competent.
ARTICLE 13 - CONFIDENTIALITY AND RIGHT OF ACCESS
TERRE D'ECOSSE will not divulge to third parties the information
given by you. This information is confidential. It will be used
within the company solely to process your order and to personalise
and improve communications as well as cultural and product offers
intended for TERRE D'ECOSSE clients. This applies primarily
to "The Albassador" newsletter to which you will be subscribed
as part of the framework of customisation of the site.
However, when you visit TERRE D'ECOSSE from certain other sites

information concerning you may be susceptible to communication
